Changing your Medicare coverage can feel overwhelming, especially if you're concerned that a health condition could make it difficult to qualify for a Medicare Supplement (Medigap) plan. The good news is that in certain situations, federal law gives you guaranteed issue rights, allowing you to purchase a Medicare Supplement policy without medical underwriting.
Understanding these rights can help you avoid coverage gaps, protect your healthcare options, and make informed decisions when your current coverage changes.
Whether you're losing employer coverage, leaving a Medicare Advantage plan, or experiencing another qualifying event, knowing your guaranteed issue rights could make all the difference.
What Are Medigap Guaranteed Issue Rights?
Medigap, also known as Medicare Supplement Insurance, helps pay many of the out-of-pocket costs that Original Medicare doesn't cover, such as deductibles, copayments, and coinsurance.
Unlike Medicare Advantage plans, Medigap policies work alongside Original Medicare rather than replacing it.
A guaranteed issue right means an insurance company must sell you an eligible Medicare Supplement policy regardless of your health status. During a guaranteed issue period, an insurance company generally cannot:
Deny your application because of your health history Require you to answer medical underwriting questions Charge you a higher premium because of a pre-existing medical condition
These protections are especially valuable because, outside certain enrollment periods, many insurance companies can use medical underwriting to determine whether to accept your application.
Does Guaranteed Issue Mean You Can Buy Any Medigap Plan?
Not always.
Federal law requires insurance companies to offer certain standardized Medicare Supplement plans during guaranteed issue situations, but it doesn't necessarily mean every Medigap plan is available.
The plans you can purchase may depend on:
The reason you qualify for guaranteed issue Your state of residence When you first became eligible for Medicare
For example, individuals who first became eligible for Medicare on or after January 1, 2020, generally cannot purchase Medicare Supplement Plans C or F.
Your Medigap Open Enrollment Period Offers the Best Protection
For most people, the best opportunity to purchase a Medicare Supplement policy is during their six-month Medigap Open Enrollment Period.
This one-time enrollment window begins when:
You are age 65 or older, and You are enrolled in Medicare Part B.
During this period, you can generally purchase any Medicare Supplement plan available in your state without answering health questions or going through medical underwriting.
Because this enrollment period offers the broadest protections, it's important to understand when it begins. Delaying enrollment in Medicare Part B can also delay your Medigap Open Enrollment Period.
Individuals who qualify for Medicare before age 65 due to disability may have different Medigap protections depending on state law. Once they turn 65 and are enrolled in Part B, they receive a new six-month federal Medigap Open Enrollment Period.
Common Situations That Qualify for Guaranteed Issue Rights
Guaranteed issue rights often apply when you're losing health coverage through no fault of your own.
Some of the most common qualifying situations include:
Your Medicare Advantage plan leaves the Medicare program. Your Medicare Advantage plan stops serving your area. You move outside your Medicare Advantage plan's service area. Your employer or union health coverage ends after Medicare becomes your primary coverage. You move outside the service area of a Medicare SELECT plan. Your Medigap insurance company becomes insolvent or misled you about your coverage. You leave a PACE (Program of All-Inclusive Care for the Elderly) plan under qualifying circumstances.
Each situation has different eligibility requirements and deadlines, so it's important to keep any notices you receive from Medicare or your insurance company.
